Terms & Right of Withdrawal
This is a translation for your convenience. The German version is legally binding.
1. Scope and provider
These terms apply to all contracts between Long Lived Games, owner Theresa Menke, Beilstraße 22, 68159 Mannheim, Germany (“we”) and consumers (“you”) for products we offer in our Etsy shop. Etsy’s terms of use also apply.
2. Conclusion of contract
The presentation of our products on this website and on Etsy is not a binding offer. By completing the order on Etsy you make a binding offer. The contract is concluded when we accept the order, at the latest when we ship the goods or provide the download.
3. Prices and shipping
The prices shown on Etsy at the time of order apply. Shipping costs and delivery times are listed under Shipping & Payment and in each Etsy listing.
4. Payment
Payment is made via the payment methods offered by Etsy. Etsy processes the payment.
5. Delivery
We ship physical products within 1 to 2 working days after payment to the address given on Etsy. Etsy provides digital products for download after payment.
6. Retention of title
Goods remain our property until paid in full.
7. Warranty
The statutory warranty rights apply. Please contact us via Etsy or at theresa.menke216@icloud.com in case of transport damage or defects.
8. Health notice
Our games contain suggestions for healthy habits and are not a substitute for medical or therapeutic advice. Adapt every challenge to your own health and fitness.
9. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier indicated by you, take possession of the goods.
To exercise your right of withdrawal, you must inform us (Long Lived Games, Theresa Menke, Beilstraße 22, 68159 Mannheim, Germany, e-mail: theresa.menke216@icloud.com) of your decision by an unequivocal statement (e.g. a letter sent by post, an e-mail or a message on Etsy). You may use the model withdrawal form in the German version, but it is not obligatory. To meet the deadline, it is sufficient to send your notice before the withdrawal period has expired.
If you withdraw, we will reimburse all payments received from you, including standard delivery costs, without undue delay and at the latest within fourteen days of receiving your notice, using the same means of payment you used. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back. You must send back the goods within fourteen days and bear the direct cost of returning them. You are only liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Digital content: For digital content not supplied on a physical medium (e.g. the planner as a PDF), the right of withdrawal expires once we have begun performance after you expressly agreed to this and acknowledged that you thereby lose your right of withdrawal.
